Case Summary

Accelerated Claims challenged a post-dismissal order awarding attorney fees to Howell and Johnson, a non-party. The Georgia Court of Appeals reversed in part and vacated in part. The court held that Georgia’s attorney-fee statute did not authorize an award to a non-party. The trial court therefore erred by awarding Howell and Johnson fees under the statute. That ruling made it unnecessary to decide whether Accelerated Claims lacked substantial justification. The court corrected the fee award while leaving the remaining judgment undisturbed.
