Case Summary

Adedamola Oni, the adoptive father of twins, previously obtained a reversal of a trial-court order setting aside the adoption. After remand, the trial court granted the biological mother’s amended motion to set aside the adoption, and Oni appealed again. The Court of Appeals examined whether the second ruling complied with the mandate in the first appeal and with the law-of-the-case doctrine. The court held that the trial court had again erred by revisiting the adoption challenge instead of entering judgment consistent with the earlier appellate decision. Under the adoption statute, the mother’s judicial challenge was time-barred because it was filed approximately ten months after the adoption decree. The court rejected the argument that changed custody circumstances or the trial court’s assessment of the children’s best interests permitted a different result; those matters could not reopen the time-barred challenge to the decree. The court reversed and remanded with direction to enter judgment in accordance with the first appellate decision. The panel unanimously concurred.
