Adell Forbes Et Al.v.James Auld Et Al.
This short opinion followed the Supreme Court of Georgia’s review of an earlier Court of Appeals decision involving statutes of limitation for wrongful-death and personal-injury claims arising from events in Belize. The Court of Appeals had applied Georgia’s limitations period to the wrongful-death claim because it viewed the Belizean rule as contrary to Georgia public policy. The Supreme Court rejected that reasoning, holding that a difference between laws is not enough to invoke the public-policy exception, and sent the matter back. On remand, the Court of Appeals vacated the relevant division of its earlier opinion and adopted the Supreme Court’s decision. The Supreme Court had not granted review of the personal-injury claim, so the Court of Appeals left intact its earlier ruling that Georgia’s general forum limitations rule governed that claim. The judgment therefore affirmed in part and reversed in part.
