Case Summary

Palm Beach County Fire Rescue disciplined captains AJ O’Laughlin and Crystal Little with written warnings for posts in a private union-election Facebook group accusing union officials and fire-department management of misusing members’ donated leave time. The firefighters challenged the County’s social-media policy under the First Amendment, asserting as-applied speech and association claims and facial overbreadth and vagueness challenges. The Eleventh Circuit held that the posts addressed a matter of public concern: they alleged corruption and commented on union leadership, and neither private communication nor election-related motive removed their protection. That resolved only the first step of the public-employee speech test, so the court remanded for the district court to balance the firefighters’ speech interests against the County’s operational interests. It also vacated summary judgment on overbreadth because the policy broadly restricted content that could adversely affect department morale, operations, or public perception. The court affirmed dismissal of the association claim because the firefighters alleged punishment for speech, not interference with their choice to associate, and affirmed the vagueness judgment because they had not adequately briefed that issue on appeal. The judgment was affirmed in part, vacated in part, and remanded.
