Case Summary

Alpha Land Partners challenged Alpharetta’s denial of a conditional-use permit and raised constitutional objections to the zoning ordinance. The superior court affirmed the permit denial but dismissed the constitutional challenges without deciding their merits. The Court of Appeals of Georgia reversed that dismissal and held that the superior court had to address the constitutional arguments in the first instance. Because those arguments could affect the sufficiency analysis of the permit denial, the appellate court also vacated the affirmance of that denial and remanded for reconsideration after the constitutional issues were resolved.
