Case Summary

Sunshine Plaza Associates sued Alterman Properties for breach of a shopping-center agreement involving maintenance and landscaping expenses. The trial court granted Sunshine Plaza summary judgment on liability, but a factual dispute remained concerning landscaping expenses. The Court of Appeals of Georgia held that the agreement and record established Alterman’s liability on the principal contractual obligations, while the landscaping issue could not be resolved as a matter of law. It therefore affirmed in part and reversed in part, preserving summary judgment on the established obligations and returning the disputed landscaping issue for further proceedings.
