Case Summary

After Mary and Elwyn Crocker were found dead, Mary’s estate sued Effingham County school officials, alleging that they had failed to report evidence of Elwyn’s abuse to law enforcement. The trial court dismissed claims against individual officials on immunity grounds. The Court of Appeals held that the complaint adequately alleged a breach of a mandatory, ministerial reporting duty by two officials, so official immunity did not justify dismissal at that stage. It reversed those dismissals and directed the trial court to reconsider claims against two others under the proper standard for judgment on the pleadings. The court stressed that it had not determined whether any official acted improperly or caused either child’s death. Its decision concerns whether the alleged duty and pleadings permit the lawsuit to proceed, not ultimate liability.
