Northside Hospital sought a declaratory judgment concerning restrictive covenants governing its relationship with American Anesthesiology of Georgia. The trial court granted Northside judgment on the pleadings, ruling that the covenants were unenforceable. The Court of Appeals of Georgia reversed. It held that the restrictive provisions had to be analyzed under the governing contract and restraint-of-trade framework and that the challenged no-hire and no-impairment provisions were not unenforceable on the grounds identified by the trial court. The court remanded for further proceedings consistent with its interpretation.
