American Civil Liberties Union, Inc.v.Zeh
B. Reid Zeh sued the American Civil Liberties Union for defamation over a blog post alleging that, as a public defender, he charged an indigent defendant for representation. The ACLU moved to strike under Georgia’s anti-SLAPP statute, and Zeh sought discovery before the motion was resolved. The Supreme Court of Georgia held that the trial court had erred by failing to decide whether Zeh was a public official or public figure and by applying the wrong framework to the motion to strike. It vacated the Court of Appeals’ judgment and remanded for the lower courts to apply the statutory anti-SLAPP procedure and resolve the public-figure issue in the first instance. The Court did not decide the truth or constitutional sufficiency of the allegedly defamatory publication.
