Jelani Asim Anthony was convicted of malice murder and a firearm offense after a shooting in Columbus. He challenged the admission of a photographic identification and argued that newly discovered information about a possible witness required a new trial. He also claimed that trial and post-trial counsel were ineffective, including because post-trial counsel was later disbarred. The Supreme Court of Georgia held that Anthony’s identification objections were not preserved on the grounds he raised on appeal and that the record did not show a basis for suppressing the identification. The court further held that the proposed witness was not shown to be relevant or favorable and that Anthony failed to satisfy the requirements for a new trial based on newly discovered evidence. Strategic decisions about investigation and cross-examination did not establish ineffective assistance, and counsel’s later disbarment did not itself prove deficient performance in this case. The court affirmed.
