Case Summary

Appen Media Group requested law-enforcement incident reports and narratives from the City of Sandy Springs under Georgia’s Open Records Act. The trial court granted summary judgment to the City, but the Court of Appeals of Georgia reversed. The majority held that the record contained factual disputes concerning whether the City had produced all responsive initial incident reports and whether additional reports existed. Those disputes prevented summary judgment for either side. The case was remanded for further proceedings under the Act. A separate opinion agreed that summary judgment was improper but emphasized the factual basis for denying relief to both parties.
