Bissonnettev.Lepage Bakeries Park St., Llc
Neal Bissonnette and Tyler Wojnarowski owned rights to distribute bakery products and sued the supplier and related companies for alleged violations of wage laws. Their contracts required arbitration under the Federal Arbitration Act, but they argued that they were exempt as workers engaged in interstate commerce. The lower courts treated the exemption as limited to workers in the transportation industry. The Supreme Court of the United States held that a transportation worker need not work for a transportation-industry employer to fall within the exemption. The statutory text focuses on the worker’s role in transporting goods across state lines, not on the industry of the employer. The Court vacated the judgment compelling arbitration and remanded for consideration of unresolved questions, including whether the plaintiffs were transportation workers and whether their work involved interstate commerce.
