Case Summary

During a drug-interdiction operation, Georgia public-safety officers damaged property owned by Blue 42 Organics. Blue 42 sued for inverse condemnation under Georgia’s Just Compensation Clause. The trial court dismissed on sovereign-immunity grounds, and the Court of Appeals affirmed because the damage arose from the State’s police power. The Supreme Court of Georgia rejected a categorical police-power exemption from compensation: outside established exceptions such as nuisance abatement and urgent necessity, invoking police power alone does not defeat a takings claim. It reversed the dismissal ruling, leaving the claim for further proceedings without deciding whether Blue 42 can prove a compensable taking.
