Case Summary

Ronnie Bonner pleaded guilty to malice murder and related charges arising from a home invasion. He later moved to withdraw the plea, challenging its voluntariness and alleging ineffective assistance. The Georgia Supreme Court vacated the trial court’s order. The court held that the trial court lacked jurisdiction to decide the merits because the motion to withdraw was filed after the term of court in which the plea was entered had expired. The proper disposition was dismissal of the motion, not a merits ruling. The Supreme Court therefore remanded with direction for the trial court to enter the appropriate dismissal order and did not decide whether Bonner’s plea or counsel was constitutionally adequate.
