Case Summary

A jury awarded $37 million after three-year-old B.W. died while receiving care at Augusta University Medical Center. The trial court cut the award to $2 million under the Georgia Tort Claims Act, rejected the parents’ emotional-distress claims and attorney fees, and declined to backdate judgment to the verdict. The Court of Appeals held that the applicable statutory cap allowed a total of $3 million for the wrongful-death and estate claims, so it ordered judgment in that amount. It affirmed rejection of emotional distress and backdating, but vacated the fee ruling for reconsideration under Georgia’s offer-of-settlement statute. The opinion explains that a large jury verdict against a state institution remains subject to statutory limits, while different claims and fee requests require separate analysis.
