Case Summary

Kiara Burroughs alleged that using several brands and units of chemical hair relaxers over many years caused her uterine fibroids and sued the manufacturers under Georgia strict-products-liability law. The manufacturers argued that all claims were barred by the ten-year statute of repose because she first bought their products long before filing suit. The Supreme Court of Georgia rejected that all-or-nothing theory and reversed in part. It held that the ten-year repose period runs separately for each product unit sold new to the end user. Older-unit claims may be time-barred, while claims tied to units sold within ten years may proceed, subject to proof of causation.
