Case Summary

Georgina Afari-Opoku sued Camelot Club Condominium Association and related parties after an incident on the condominium property caused injury. The case went to trial, and the court entered judgment allocating fault and imposing liability on Camelot for the share assigned to another entity. On appeal, the Court of Appeals affirmed the evidentiary and liability rulings that were supported by the trial record. It nevertheless vacated the portion of the judgment imposing vicarious liability on Camelot for the other entity’s assigned fault. The court held that the jury’s verdict controlled and that the judgment could not add liability beyond the verdict or impose a legal theory the jury had not found. The case was remanded with direction for the trial court to enter judgment consistent with the jury’s allocation of fault. The disposition was affirmed in part and vacated in part, with remand for a corrected judgment. Two judges concurred.
