Case Summary

Clarence Casey was convicted of felony murder and firearm possession after Alred Bradley was shot. The Georgia Supreme Court held that the trial court failed to exercise its discretion as the thirteenth juror when ruling on Casey’s motion for new trial. Although the evidence was sufficient as a matter of constitutional due process, the trial court had to independently weigh the evidence and assess witness credibility under Georgia’s general-grounds statute. The Supreme Court therefore vacated the order in part and remanded for the trial court to apply the correct standard. It did not reach Casey’s remaining evidentiary claim because that issue might be affected by the renewed new-trial ruling.
