Case Summary

The Catoosa County Republican Party required local primary candidates to obtain an interview and approval affidavit from its executive committee in addition to Georgia’s statutory qualifications. Rejected candidates sued. The Supreme Court of Georgia held that the county organization could not add this ballot-access condition under the state election code: it was not the political party authorized by that provision to prescribe candidate qualifications. The court also rejected the claim that the injunction against using the rule violated the organization’s freedom of association; the order governed the public primary ballot, not membership in the local group. It affirmed in part and reversed in part in the party’s appeal. In a companion appeal, it dismissed nonparty committee members’ challenge to attorney fees because they had not used the required discretionary-appeal procedure.
