Case Summary

Cheryl Lynn Fields sued William Taylor and others after an accident caused serious injuries, and the trial court granted Taylor summary judgment. Fields appealed, arguing that expert evidence created a genuine dispute about causation. The Court of Appeals agreed and reversed because the record, viewed in Fields’s favor, permitted a jury to find that Taylor’s conduct contributed to the injuries. The court also concluded that the expert affidavits were not subject to exclusion on the grounds asserted at summary judgment and that the competing expert opinions presented factual questions rather than a basis for judgment as a matter of law. In a related cross-appeal, the court affirmed the ruling concerning the other defendant. The final disposition was reversed in Fields’s appeal and affirmed in the cross-appeal. Two judges concurred.
