Case Summary

Christopher Brooks, an Alabama death-row inmate, sought an emergency stay of execution while challenging Alabama’s lethal-injection protocol. The Eleventh Circuit held that Brooks had not shown a substantial likelihood of proving either that a readily available alternative method posed a materially lower risk of severe pain or that his challenge was timely under the applicable limitations period. The court also held that his unjustifiable delay weighed strongly against the equitable relief requested. Because he failed to establish a likelihood of success or favorable equities, the court affirmed the district court’s denial of a stay and denied the emergency motion filed in the Court of Appeals.
