Case Summary

After Eric Walker died by suicide while in jail, his surviving spouse and estate administrator sued jail officers for wrongful death. A jury returned a defense verdict, and the trial court denied the plaintiff’s post-trial motions. The Court of Appeals of Georgia reversed and remanded after identifying errors concerning evidence and argument about jail policies, the handling of alleged negligence, the redaction of the policy, and the failure to qualify the jury about an interested insurance carrier. The court held that the trial court should have allowed voir dire concerning the interlocal risk-management agency if it qualified as an insurance carrier with a financial interest. It directed the trial court to address that issue and conduct further proceedings on retrial.
