Case Summary

James Rashad Clay was convicted of malice murder and related offenses and represented himself on appeal. He raised numerous claims, including challenges concerning the trial, the record, and the delay in processing his post-conviction appeal. The Georgia Supreme Court affirmed. The court held that Clay failed to show that the alleged trial errors affected the verdict or that the record supported his remaining claims. It also rejected his due-process challenge to the post-conviction delay. Although the court considers the length and reasons for delay, the defendant’s assertion of the right, and prejudice, a conviction will not be reversed without a showing that the delay impaired the ability to present the appeal and created a reasonable probability of a different result. Clay did not make that showing.
