Case Summary

Cobb County voters challenged a county commission amendment that changed district boundaries enacted by the Georgia General Assembly. The trial court ruled that the county’s action exceeded its constitutional home-rule authority. The Supreme Court of Georgia held that the voters had constitutional standing but had not shown the uncertainty about their future conduct necessary to obtain declaratory relief. The Court reversed the judgment granting declaratory relief and dismissed the claim without deciding whether the county amendment was unconstitutional. A concurrence agreed with the result but urged the county to obtain a prompt merits-based resolution because continued litigation could disrupt the functioning of the county commission.
