Case Summary

A plaintiff sued a county sheriff and Clayton County after an allegedly negligent collision involving a county vehicle. The Supreme Court of Georgia considered whether an official-capacity claim against a sheriff was a claim against the county under Georgia’s statutory presentment requirement and whether presenting the claim to the county commission satisfied that requirement. The Court held that the statute applies to this type of claim and that the Court of Appeals had used the wrong recipient and analysis in deciding whether presentment was sufficient. It affirmed in part and reversed in part, remanding for further proceedings under the correct interpretation. The Court expressly left open whether presentment to the sheriff could also satisfy the statute.
