Connie Lockhart sued an emergency-room physician and his employer, alleging that an improperly placed intravenous line caused the amputation of her leg. After the trial court directed a verdict for the defendants, Lockhart appealed. The Court of Appeals of Georgia reversed and remanded for a new trial. The court held that a directed verdict is proper only when the evidence demands one result, and that the trial court erred by selectively disregarding unobjected-to testimony from a defense expert when deciding whether Lockhart had presented evidence supporting her medical-malpractice claim. Because the trial court had not identified authority permitting that selective treatment of the record, the appellate court concluded that the directed verdict could not stand. It did not reach Lockhart’s remaining arguments.
