Case Summary

After a rear-end collision, Jack Cravens sought $50,000 in liability coverage and $100,000 in uninsured-motorist benefits from the same insurer; his claimed medical costs exceeded $150,000. The insurer accepted his UM demand while the liability settlement and release were still disputed. The Court of Appeals applied an exhaustion rule that required the liability claim to be settled first. The Supreme Court of Georgia held that rule does not bar settling a UM claim before the liability claim is settled. It vacated the Court of Appeals’ decision and remanded to reconsider the motion to enforce settlement under that clarification, leaving whether a settlement actually occurred for the appellate court to decide.
