Crippen & Lawrence Investment Co., Inc.v.A Tract Of Land Being Known As 444 Lemon Street Et. Al.
A property owner received land by testamentary devise but never obtained a deed from the estate. After taxes went unpaid, the property was sold at a tax sale and the purchaser sought to foreclose the statutory right of redemption. The Georgia Supreme Court considered whether the owner had standing to establish that the estate had already assented to the devise. The court held that the governing probate statute did not limit that type of standing to heirs or beneficiaries. A person with a proper interest could seek a determination that assent had already occurred in one of the forms recognized by the statute. The court affirmed the Court of Appeals and resolved the statutory standing question without disturbing the underlying property procedure.
