Case Summary
After a tax sale and an attempt to foreclose the right of redemption, Crippen and Lawrence Investment Company sought to quiet title to a Marietta property formerly occupied by Jennifer Hood. The Court of Appeals of Georgia held that the trial court erred in resolving notice and title issues without first determining whether the executor of the estate had assented to the transfer of the property to Hood. That determination affected whether the executor was entitled to notice of the redemption foreclosure. The court reversed and remanded with direction for the trial court to decide the executor’s assent before allowing the quiet-title case to proceed.
