Case Summary

A jury convicted Denirio Cunningham of murder and numerous offenses after he and a co-defendant entered an apartment, shot David Rucker, threatened Rucker’s family, and fled. The Supreme Court of Georgia affirmed most convictions but reversed the convictions for false imprisonment and the firearm charges tied to those counts. The evidence showed the apartment invasion, the shooting, Cunningham’s admissions to an accomplice, incriminating statements in jail, and an attempt to silence a potential witness. The Court held that the evidence was sufficient for the surviving convictions and that evidence of a prior armed robbery was properly admitted for the permitted purposes identified by the evidence rules. The State did not prove every element of false imprisonment beyond a reasonable doubt, however, and the related firearm convictions could not stand. The Court also rejected Cunningham’s ineffective-assistance claim because the trial court credited counsel’s testimony that no alibi witness had been identified and found that the proposed witness would not have changed the result. The judgment was affirmed in part and reversed in part.
