Case Summary

In three related appeals, D. Richard Wells, Magwell, and First Nolia challenged a trial court order vacating an arbitration award and sending the matter back to the arbitrator for a limited rehearing. The Court of Appeals of Georgia upheld the decision to vacate the award but held that the trial court’s directions for the rehearing went too far. The appellate court interpreted the parties’ operating agreement and concluded that only the issue of arbitration expenses remained for the arbitrator. It therefore vacated portions of the rehearing order and remanded with direction for the trial court to order a rehearing limited to those expenses. The court addressed numerous challenges arising from the parties’ arbitration and preserved the judgment in all other respects.
