Case Summary

In consolidated appeals, David Stone challenged orders awarding joint legal custody of his minor child to him and the child’s maternal grandmother. While the appeals were pending, the Supreme Court of Georgia held in Stone v. Stone that when a parent is suitable to exercise custody, Georgia law does not permit parental custody to be limited through a joint-custody arrangement with a grandparent or another nonparent. The Court of Appeals of Georgia applied that controlling decision, vacated the appealed orders, and remanded for reconsideration in light of it. The court did not independently resolve the custody merits.
