David Eichenblatt appealed an award of more than 837,000 dollars in attorney fees to Piedmont/Maple, its development partners, and an individual defendant under Georgia’s offer-of-settlement statute. The dispute arose from a long-running real-estate investment case in which Eichenblatt had alleged mismanagement, breach of an operating agreement, and fiduciary violations. The Court of Appeals focused on whether the defendants’ settlement offer was legally enforceable when the underlying action included both tort and contract claims. Relying on its recent authority, the court held that the offer was unclear because the contract claims were independent of the tort claims and could not be treated as entirely premised on them. The trial court therefore erred in enforcing the offer under the statute. The Court of Appeals reversed the attorney-fee award and declined to reach the remaining appellate arguments.
