Case Summary

DHS connected Social Security Administration records to its SAVE system so election officials could check the citizenship status of registered voters. The League of Women Voters and other groups argued that the data sharing violated Social Security confidentiality provisions, the Privacy Act, and the Administrative Procedure Act; a district court vacated the changes. The Supreme Court granted a stay, reasoning that the government was likely to show that 8 U.S.C. § 1373 authorizes DHS to request and receive citizenship-status information despite those restrictions. The stay permits individualized checks while the appeal proceeds; the Court did not decide whether the National Voter Registration Act bars systematic voter-list removals within 90 days of an election. Justice Jackson dissented.
