Case Summary

A driver lost control of his vehicle during a commute and struck another vehicle, killing Tuan Minh Nguyen and his brother-in-law. The Georgia Court of Appeals considered negligence claims against the driver’s employer and related parties. The court held that the employer was not liable for an employee’s ordinary commute under the general coming-and-going rule. Evidence that a manager knew the driver used drugs did not create a duty to investigate his driving history because the driver was not making a delivery when the collision occurred. The court rejected the claim that the employer’s business relationship with the driver changed the result and affirmed the applicable judgment.
