Case Summary

An employer claimed that sales representatives were exempt from the Fair Labor Standards Act’s minimum-wage and overtime requirements. The Court held that the employer bears the ordinary preponderance-of-the-evidence burden when proving an exemption. The heightened clear-and-convincing standard applied by the lower court was inconsistent with the statute and ordinary civil burdens.
