Case Summary

Property owners challenged the State’s development of Rivian electric-vehicle manufacturing facilities on state-owned property and sought declaratory and injunctive relief. At the State’s request, the trial court required the plaintiffs to post a substantial surety bond. The Court of Appeals of Georgia vacated and remanded. It held that the trial court had to reconsider whether the bond was authorized and appropriate under the governing statute before the appellate court could address the remaining issues. Because the bond ruling required a new analysis, deciding the other arguments would have produced an advisory opinion. The case was remanded for further proceedings.
