Edward Gilreath and Sherrie Conner’s divorce agreement awarded Conner a percentage of Gilreath’s pension. After Gilreath retired and failed to pay her share, Conner moved for clarification of the divorce decree and for contempt. The trial court denied contempt but determined that Gilreath owed Conner 27.4 percent of his monthly pension. The Court of Appeals of Georgia vacated and remanded. It held that a trial court may clarify a divorce decree while resolving a contempt matter, and may also consider a clarification request even when contempt is not found. The court concluded that the trial court had jurisdiction to interpret the decree and directed further proceedings consistent with its opinion.
