Case Summary

Orthopaedic surgeon Jason Harms sued Emory Healthcare and others over peer-review proceedings and alleged interference with his ability to practice. The defendants sought dismissal and striking of the claims under Georgia’s pleading statute and anti-SLAPP law after Harms was placed under precautionary suspension and later stopped exercising hospital privileges. The Court of Appeals of Georgia held that the trial court should have granted the motions as to most claims, but it left the tortious-interference claims in place. The court affirmed in part and reversed in part, applying the governing peer-review and statutory standards to the allegations and the hospital’s credentials policy.
