Estelle Roberts Et Al.v.Mary Jackson Smith, Executor Of Estate Of Johnnie James Smith, Jr.
Siblings made an informal arrangement to contribute money toward a home that one sibling purchased for another sibling’s use. After the purchasing sibling died, the executor claimed the property and related assets, while the other siblings sought an accounting, payoff information, damages, and recognition of their interests. The trial court granted the executor summary judgment on all claims. The Georgia Court of Appeals reversed. It held that the evidence about the siblings’ agreement and contributions created factual issues concerning whether an enforceable contract existed and whether the estate could retain the benefits of the arrangement. The court also rejected summary judgment on the accounting and property-related claims where the record did not support the trial court’s conclusions. Because material factual and legal questions remained, the court returned the case for further proceedings rather than resolving the parties’ competing ownership claims.
