Case Summary

Stephanie Allred sought uninsured-motorist benefits under her parents’ automobile policy after a vehicle struck her in Atlanta; Progressive argued she no longer qualified as a resident of their household. The Court of Appeals held that residence depends on the aggregate details of the family’s living arrangements, including household membership and intent, and ordinarily presents a jury question. Because Allred had evidence that she kept a room in her parents’ Ohio home, received their financial support, and moved back after the accident, a jury could find she remained a resident relative under the policy. The court reversed summary judgment for Progressive.
