Case Summary

Robert Mallory sued Norfolk Southern in Pennsylvania over alleged workplace exposure, although the company was incorporated and headquartered elsewhere. Norfolk Southern had registered to do business in Pennsylvania under a statute treating registration as consent to general personal jurisdiction. The Court held that the company's express consent through registration could support general jurisdiction and that the Due Process Clause did not itself prohibit that consent on the facts presented. The judgment was vacated for further proceedings on issues not resolved by the Supreme Court.
