Case Summary

Terry Joyner, an Atlanta police officer, challenged the denial of a captain promotion and a later change from a flexible to a fixed work schedule. He asserted racial discrimination and retaliation under Title VII, First Amendment retaliation, and a Georgia Whistleblower Act claim. The Eleventh Circuit affirmed the rulings for the defendants on all claims except the First Amendment retaliation claim against Chief Turner and Major Hobbs, for which it reversed the qualified-immunity summary judgment. The panel remanded that claim for further proceedings.
