Case Summary

Ronald Fisher was convicted at a second trial of malice murder and related offenses in the shooting death of Derrick Cullins. He argued that the only identifying witness was an accomplice, that a detective improperly testified about the witness’s status, and that counsel was ineffective for not objecting to the prosecutor’s closing argument. The Georgia Supreme Court affirmed. The court held that the evidence, including corroborating circumstances, authorized the convictions and that the detective’s testimony did not establish reversible error. It also rejected the ineffective-assistance claim because the proposed objection to closing argument would not have been meritorious. The court left the retrial judgment and sentence undisturbed.
