Case Summary
Roodson Fleureme alleged that a City of Atlanta vehicle struck him; before suing, he sent timely ante litem notices by statutory overnight delivery, including one addressed to the Office of the Mayor at the correct City Hall address. The trial and appellate courts dismissed his suit, reasoning that Georgia’s ante litem statute required delivery to the mayor personally and by name. The Supreme Court of Georgia held that delivery to the mayor’s office at the correct address satisfies OCGA § 36-33-5 (f); the statute imposes no hypertechnical naming requirement. It reversed and remanded.
