These consolidated appeals arose from a fraudulent-transfer judgment involving Russell and Amarynthia Carbonara and Fortress Group. The Georgia Court of Appeals reversed the judgment in Fortress’s appeal because the trial court failed to transmit the trial transcript within the required period and did not adequately determine that the delay was unreasonable. The court held that the record did not support treating the transcript delay as attributable to the appellant and that the procedural defect prevented proper review. The Carbonaras’ separate appeal was dismissed in light of the disposition of Fortress’s appeal.
