Franklin Selvagev.Latrina Franklin
Franklin Selvage sought to modify custody, child support, and visitation after a history of domestic violence, protective orders, and prolonged absence from his child. The trial court had granted him legitimation but denied visitation, declined to enter a new child-support award, and failed to include a permanent parenting plan. The Court of Appeals vacated and remanded. It held that the trial court’s order did not contain the detailed findings needed to support the complete denial of visitation or the child-support ruling, including the required statutory worksheet or addendum. The court also held that Georgia law required a parenting plan with details beyond the bare allocation of custody and visitation. Referring to an earlier order that also lacked a compliant plan did not cure the defect. The ruling requires the trial court to make the statutory findings and enter an order that addresses the child’s interests and the required parenting-plan details while preserving the safety concerns shown in the record.
