Case Summary
The Fulton County Republican Party nominated Jason Frazier and Julie Adams for seats on the county Board of Registration and Elections. The county commissioners declined to seat them, but the trial court issued a writ of mandamus ordering the appointments and later held the commissioners in contempt. The Court of Appeals of Georgia held that the trial court interfered with the commissioners’ constitutional authority and discretion to appoint public officers. Because the commissioners had acted within that authority, mandamus was improper and the contempt order could not stand. The court reversed both judgments.
