Case Summary

The Georgia Department of Community Health and the Hospital Authority of Monroe County litigated whether a medical complex qualified for a statutory exemption from a diagnostic-equipment threshold. An administrative hearing officer issued a final decision, but the superior court reversed that decision and ordered the Department to conduct a further investigation. The Court of Appeals reversed the superior court. Applying the Administrative Procedure Act and the governing health-facility statutes, the court held that the record and statutory framework supported the agency’s treatment of the equipment and did not authorize the superior court to substitute its judgment for the agency’s on the issue presented. The appellate court also denied the Department’s request to vacate and remand the judgment on a separate procedural theory because the appeal remained properly before the court. The superior court’s judgment was reversed. Two judges concurred.
