Case Summary

The Georgia Government Transparency and Campaign Finance Commission sought enforcement of administrative subpoenas issued during an investigation into campaign disclosures involving New Georgia Project entities and a gubernatorial campaign. The superior court concluded that it lacked jurisdiction and denied the Commission’s motion. The Court of Appeals of Georgia reversed and remanded. It held that the Commission could invoke the statutory procedure for enforcing its subpoenas and that doing so did not deny due process because the subpoenaed parties could move to quash and would receive notice and an opportunity to be heard in later court proceedings.
